3. PRICE

Prices are expressed exclusively in euros (€) including VAT, excluding shipping costs. Our selling prices are those indicated on the electronic catalog of the site when ordering. The electronic catalog is regularly updated.

The fixed price of transport is calculated as accurately as possible per bottle according to the quantity ordered. We can make requests for express delivery or collection from our cellars or our office free of charge by appointment. The prices displayed do not take into account any reductions applicable on the day of the order.

The reductions, if any, are included in the summary of the shopping cart before the validation of the order. CLOS DES MILLESIMES reserves the right to modify its prices at any time, it being understood, however, that the price displayed on the day of the order will be the only one applicable to the buyer.

In the event of a manifest error in a price in € including tax which would be abnormally lower than a normal price at another merchant (for example price at 0€ or 15 € instead of 150 €) the company Clos des Millésimes gives itself the right to cancel the sale, to reimburse the customer in full. No compensation can be requested.

5. ORDERS

6. WITHDRAWAL

Shipping and return costs are the responsibility of the buyer. For partial returns of the products ordered, no refund of the initial shipping costs can take place.

CLOS DES MILLESIMES will not accept parcels sent postage due. CLOS DES MILLESIMES will reimburse you for products returned in perfect condition for resale, complete, in their original packaging and accompanied by a copy of the invoice.

7. PAYMENT TERMS

Any order of deliverable wine can only be validated if it is accompanied by payment (credit card, check, bank transfer) of the full price including VAT and shipping costs. Our prices are subject to sale, without commitment, subject to stock available. The valid prices are those indicated at the time of the order as they appear on our site (except error or omission). 11. DESTRUCTION/BREAKAGE

In the event of destruction of the goods before the date scheduled for delivery of the order, in the absence of stock available to replace it, the buyer will be reimbursed for the sums paid by him, excluding any other compensation, within 30 days from the date of the loss.

12. DELIVERIES

Deliveries are made to the address indicated in the online order form, which can only be in the geographical area agreed above.

The risks are borne by the buyer from the moment the products are taken over by the carrier. CLOS DES MILLESIMES will send an email confirming dispatch with the details of the package upon dispatch. Bring an identity document and your notice of passage. The order specifies the place of delivery or, where applicable, the will of the buyer to proceed himself to the removal of the goods within the seller's cellar. The buyer must receive or remove the goods within a maximum period of 30 days following receipt of his order. Any modification of the place of delivery must be indicated by the buyer to the seller in good time and in any case before the order is taken over by the carrier. If, exceptionally, the buyer were to notice the absence of delivery within the time indicated above, he should immediately notify Clos des Millésimes to enable him to remedy the problem as soon as possible, the execution of the order then having to intervene. at the latest within 30 days of the latter.

The presentation of the goods at the place and on the date indicated by the buyer releases the seller from his obligation to deliver. In the event of the buyer's absence during the presentation of the goods, as far as possible and depending on the circumstances: For orders less than or equal to 18 bottles and for express deliveries, the package will be stored at the post office indicated on the delivery receipt deposited in the mailbox of the recipient, the latter having to deal with the withdrawal.

For orders over 18 bottles, in principle delivered by a road carrier, the latter will contact the buyer for a second delivery, provided that the latter has provided a telephone number enabling him to be reached during the day. If the buyer has chosen to collect or have the goods collected from the seller's cellars, they will only be delivered to the person placing the order. To validate his identity, an identity document will be requested.

If the author of the order cannot go to the cellars, he can ask a third party to come in his place. This person must be provided with a power of attorney established by the author of the order, and to which will be attached a copy of one of his identity documents.

13. WINE QUALITY

The wines offered have been approved by sworn brokers and have never left our cellars located in Bordeaux since their direct acquisitions from the estates. Concerning the old vintages, our quality of expert authenticates the authenticity of the bottles and the vintages.

CLOS DES MILLESIMES cannot, however, be held responsible for any deterioration in quality caused by the transport of the wine or natural accidents linked to the nature of the product and accidents (cork taint, oxidation, reduction, or excessive volatile acidity). However, we carry out regular tastings and only buy wines that we trust and in the best possible conditions.

In the event of a dispute, only an analysis of the bottle or bottles in question must be carried out by an oenological laboratory approved by the courts of Bordeaux. The bottle(s) must be returned as soon as possible to our customer service. The content of the bottle must be at least 85% of the original content with the original cap. If the analyzes turn out to be negative, the goods will not be reimbursed as well as the return costs.

14. FORCE MAJEURE

CLOS DES MILLESIMES cannot be held liable for loss, damage or non-delivery of an order resulting from a case of force majeure (such as storms, floods, road accidents).

15. ATTRIBUTION OF JURISDICTION

The CLOS DES MILLESIMES Customer Service is at your disposal to resolve any problem resulting from an order and its execution. If it is impossible to reach an agreement, all conflicts arising from the execution of an order or the interpretation of these conditions, and more generally of agreements of any kind concluded between the parties, will be assigned to the competent court.

16. EXCHANGE AND REFUND

In accordance with Article 1641 and following of the Civil Code, the provisions hereof cannot deprive the consumer of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of hidden defects of the thing sold.

As part of the return, the delivery costs are the responsibility of the buyer.
